Image Licence Agreement

1. About This Licence
By purchasing and downloading an image from the Aerial Advantage Stock Library ("Library"), you ("Licensee") agree to be bound by the terms of this Licence Agreement. Aerial Advantage Pty Ltd ("Licensor") retains full copyright in all images.
2. Licence Tiers
Two licence tiers are available. Both are for web use only and are priced in Australian Dollars (AUD) inclusive of GST.

3. What You May Do
- Use the licensed image in digital/online publications, websites, social media platforms, and digital marketing materials.
- Resize, crop, or colour-grade the image for your permitted use.
- Use the image for the duration of your project with no expiry, provided use remains within the permitted scope.
4. What You May Not Do
- No print rights. This licence does not cover physical print, merchandise, billboards, signage, or any other printed medium.
- No resale or redistribution. You may not sell, sublicence, share, or redistribute the image file itself, whether modified or unmodified.
- No editorial misrepresentation. You may not use the image in a way that is defamatory, misleading, or that implies endorsement by any person depicted.
- No NFT or AI training. The image may not be minted as an NFT, used to train AI models, or incorporated into AI-generated datasets.
- No removal of metadata. You may not strip embedded copyright or EXIF metadata from the file.
5. Licence Scope
Each licence covers a single image for a single project or campaign. Use of the same image across multiple separate projects requires a separate licence per project. The licence is non-exclusive — the Licensor may licence the same image to other parties.
6. Attribution
Where reasonably practical, please credit the image as: Photo: Aerial Advantage (aerialadvantage.com.au). Attribution is encouraged but not mandatory for web use.
7. Copyright
All images remain the exclusive copyright of Aerial Advantage Pty Ltd. Nothing in this agreement transfers ownership or copyright to the Licensee. Unauthorised reproduction, distribution, or commercial use outside the scope of this licence may constitute copyright infringement and may be subject to legal action.
8. Warranty & Liability
Images are provided "as is". The Licensor warrants that it holds copyright in all images. To the maximum extent permitted by law, the Licensor's total liability for any claim arising from use of a licensed image is limited to the licence fee paid for that image.
9. Governing Law
This agreement is governed by the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.
